The University requires that background checks be completed in a manner that is compliant with applicable federal and state law on all of its employees and others covered by this policy as part of the hiring/selection process (see Section I, Who is Covered by this Policy ). In addition, the University requires its employees and others covered by this policy, including those hired or engaged prior to the effective date of this policy, to disclose any criminal conviction within five calendar days of the occurrence (see Section IX, Ongoing Responsibility to Disclose Criminal Convictions ). In consultation with the Office of University Counsel, the University may conduct a background check on a current employee if information becomes available that brings into question whether a particular employee is compliant with this policy. 1.2 It is the policy of the University of Wisconsin Board of Regents that all UW System campuses have a comprehensive policy of conducting criminal background checks on current employees and volunteers holding or seeking a position of trust with access to vulnerable populations. For the purposes of this policy, current CSU employees are required to undergo background checks if under voluntary consideration for a position in which a background check is required by law or for a sensitive position (with limited exceptions). Criminal background checks must be conducted on current employees holding a position of trust with access to vulnerable populations, as defined in the above paragraphs of this policy, who have not previously been subject to a criminal background check by the University.

Current UW System Administration employees who are moving to a position within UW System Administration through transfer, promotion, or otherwise, will not be subject to a criminal background check unless such a check is otherwise required by law (e.g., the fiduciary responsibility law or caregiver law), the majority of the position's duties will be performed within residential facilities, or it is the practice of UW System Administration to conduct criminal background checks on current UW System Administration and UW System employees who are candidates for certain positions of trust. Currently, federal law requires background checks (through the National Instant Criminal Background Check System ) only for guns sold through licensed firearm dealers , which account for 78% of all gun sales in the United States. In addition to the appropriate U.S. criminal background check that will be conducted for a new hire, current employee, or volunteer who is a foreign national and subject to this policy, a criminal background check in the individual's prior country(ies) of residence will also be conducted if his/her country(ies) of residence provides criminal background checks for the time period during which the individual was a resident.

The FBI seal is seen outside the headquarters building in Washington, D.C. Under current federal law, all licensed gun dealers must contact the National Instant Criminal Background Check System (NICS) run by the FBI before making a sale. Current employees whose employment record remains active in the University's human resources system during a period of non-pay are not required to undergo a new background check upon resuming paid service. Christine James, records manager for the Auburn Police Department, said she is training more of her employees on background-checks — but those workers are already busy with their current tasks.

For student applicants to a position requiring student status, the University may rely on a criminal background check performed at the University within the past sixty (60) months as long as the student has maintained continuous enrollment during the long semesters, the student is employed in the same job or one with the same criminal background check requirements, and the student is required to report any charges or convictions (including current or upcoming registry as a sex offender), excluding misdemeanor offenses punishable only by fine. For current employees, changes in employment initiated by the employee (e.g. application to a competitive recruitment or acceptance of a new position via direct appointment) will require a background check if the new assignment is designated as requiring a background check or required check(s) was not previously performed. 1.3 For individuals that are not currently employees of a UW System institution, criminal background checks should be completed before an offer of employment is made.
